Responses requested on trade secrets questionnaire

 

MARQUES members are invited to respond to a questionnaire on trade secrets, which is being conducted by KPMG for the European Observatory on Infringement of Intellectual Property Rights


The questionnaire is part of the study titled “Baseline of Trade Secret Litigation in the EU”. It aims to analyse the level of trade secret litigation in the 28 EU Member States, as well as the profiles of the parties involved in litigation, courts dealing with trade secret matters and the duration of proceedings.

The questionnaire covers the period 2006 to 2016 and so will provide a snapshot of the status quo of litigation before the transposition/implementation of the 2016 Trade Secrets Directive and will be used as a benchmark/baseline for the related report on litigation trends.

About the questionnaire

The questionnaire is in two sections. The first section covers general information on trade secrets (such as jurisdiction, preservation of trade secrets during litigation and trade secrets’ holders perceptions).

The second section of the questionnaire covers information on trade secrets cases, such as courts, profiles of parties, data, cross-border issues and remedies.

MARQUES encourages all members with experience of trade secrets to respond to the questionnaire and send responses to MARQUES External Relations Officer Alessandra Romeo. She will forward all responses received to KPMG.

The questionnaires can be filled in anonymously and the deadline for submissions is 29th September 2017.

The EU Commission has a page dedicated to trade secrets, which includes links to the Trade Secrets Directive and a summary of responses to the public consultation.
