From the Observatory...   Council adopts position on Designs Directive and Regulation

The MARQUES Anti-Counterfeiting and Parallel Trade Team shares its regular monthly update on IP enforcement developments, this month focusing on Madrid Fashion Week

 

The Council of the EU adopted its position on the proposed recast Directive on the legal protection of designs and its position on the proposed amended Regulation on community designs on 25 September

This is a significant step in the legislative process for design reform. The Council will now negotiate with the European Parliament and the trilogue process is expected to start in early 2024, meaning the legislation could be adopted and enter into force in the first half of next year.

Amendments introduced by the Council include:

  • A further update of the definition of "design" and "product".
  • A simplification of the requirements for representing a design and allowing to grant a "filing date" even if formal design representation deficiencies exist, provided that design representation is clear enough.
  • Clarification that national administrative invalidity procedures are possible but not mandatory.
  • Further changes to the fee regime to ensure that fees for national-only design protection remain cheaper than European ones.
  • An extension of the transposition period for Member States to implement the new legislation to 36 months.
