The Swedish new order of trademark law proceeding.
The Patent and Marketing Court starts the seminar by focusing on the new
order of handling trademark registrations - the court’s handling of trademark
matters, new procedural rules, the issue of the Patent and
Registration Office’s role as party in appeal cases re. registration
matters, joinder of cases etc.
The Patent and Market Court of Appeal continues by focusing on
issues such as preclusion, ex officio examination and the procedure before the
superior courts and in particular issues such as preclusion and ex officio
examination as well as which courts are competent to try cases of recovery of
ownership to trademark. The Swedish PTO’s comments on their thoughts and actions
as counterpart, especially their particular considerations re.

The Swedish Trademark Law Proceedings in Relation to the EU Law.
The Patent and Market Court of
Appeal addresses in general the impacts of the EU law, in particular
the degree of harmonisation, conform interpretation of Directives,
the courts’ role in issues of preliminary ruling from the European
Court of Justice, the impacts of EU case law regarding the
examination of registration matters from EUIPO compared with
preliminary rulings from the European Court of Justice etc.
Thereafter The Patent and Marketing Court comments the impact of EU
law, in particular the new Trademark Directive, the impact on the
process in first instance. The Swedish PTO describes in particular
their cooperation with EUIPO. |
