French forks: a damages decision
The latest issue of OHIM's Alicante News contains a beautifully illustrated note on a judgment of the Cour d'apped de Paris of 5 December 2014 in case 14/03506, ‘Forks’. This judgment rules on the appeal against the decision of the trial court in an infringement action involving two Community designs (Nos 001647769‑0001 and 001647769‑0002). This decision is particularly interesting for its approach to the assessment of damages where the infringing goods are mass-produced products, each of which is of very low value (having a unit price of 0.025 euro).
