Unregistered Community Design - cases on subsistence?
Estelle has another question.
Can anyone please let us know of any cases concerning EU Unregistered Community Design Right coming into existence. She is aware of:
1 - I ZR 126/06 - Gebäckpresse II, 9 October 2008, German Federal Supreme Court (Bundesgerichtshof, BGH) [2009] GRUR 79.
2 - Regional Court of Frankfurt - Ab Swing Hometrainer decision: Thane International Group's Application (3/12 O 5/04) [2006] E.C.D.R. 8
3 - 730/2005C, Dijsmans Schoenen BV v Mustang Inter SL, 25/10/2005, Commercial court of Alicante,
I guess the German cases will probably follow Gebäckpresse II. I don't know of any UK cases. What have we got from the rest of Europe? Specifically, is there any case law in which UCD has existed with a first disclosure outside the EU? Posted by: David Musker @ 15.43
