Ikea, Idea marks insufficiently similar, says CFI
The Court of First Instance (CFI) has dismissed the appeal of IKEA today in Case T‑112/06, Inter-Ikea Systems BV v Office for Harmonisation in the Internal Market, Walter Waibel. In its opinion there was no likelihood of confusion between the IKEA mark and Herr
Waibel's subsequently-granted IDEA Community trade mark where the respective goods and services were identical. According to the CFI, the marks at issue were visually and conceptually dissimilar, with only a low degree of aural similarity. Accordingly the application for cancellation of the IDEA mark was dismissed.
