Country information on warning letters
The MARQUES Anti-Counterfeiting and Parallel Trade Team has compiled a new resource for MARQUES members, providing an overview of the law and practice on sending warning letters in various jurisdictions.
The information is presented in a table, which can be downloaded from the Team page (MARQUES log in required).
The purpose of the overview is to present recommended and required steps in various countries regarding sending warning letters.
Therefore, the questionnaire concerns different types of acts such as counterfeit/IP infringement, online infringement/takedown, parallel import and unfair competition/passing off.
The table is likely to prove useful to anyone who is involved in sending warning letters regarding infringement, particularly in multiple jurisdictions.
The table will be periodically extended with the addition of new material by members of the Team.
