No re-introduction of the fast track examination for UK trade marks
The outcome of the UK IPO's recent consultation (see earlier post here) on whether to reintroduce the fast track examination procedure for UK national trade marks has now been published.
The response document, which can be retrieved by clicking here, "indicates the government’s intention not to reintroduce this service, based on the lack of demand identified in the responses that were received." [emphasis by Class 46]
A summary of the responses received can be found on page 10 of the response document, a list of the nine respondents on page 12.
By way of background, the UK IPO had introduced the consultation as follows: "The fast track procedure was originally introduced in April, 2008, but suspended in 2009 due to a combination of the low take up, and the short timescales to examination using the standard procedure, at that time. In late 2012 the idea of reintroducing the service was raised. However, since then, the introduction of a new electronic processing system has meant that examination periods using the standard procedure are again very short. We believe that it is now an appropriate time to consult on the need, and demand for the reintroduction of such a service."
