In Case T-366/12, the General Court confirmed OHIM’s
decision to refuse registration for the following sign on absolute grounds for
Class 30 goods ‘confectionary and sweets except chewing-gums’:
The two words taken together will be understood by the English-speaking consumer as an immediate reference to the products in question. The additional figurative elements and colours are too weak to confer the necessary distinctive character. Therefore, the sign is descriptive and lacks distinctive character according to Article 7 (1) b) and c) of CTMR.
