CASTEL v CASTELL battle heads for CJEU
In November, Laetitia reported on the General Court ruling in Case T-320/10, in which Castel Frères SAS (France), having obtained registration of the word CASTEL as a Community trade mark for wines, lost it following a successful cancellation action brought by Fürstlich Castell’sches Domänenamt Albrecht Fürst zu Castell-Castell (Germany), which based its cancellation action on the Geographical Indication Castell, protected for wines in Germany, France, Greece, Italy and Spain.
That decision is now being appealed to the Court of Justice of the European Union as Case C-622/13 P. Watch this space for further developments.
