JELZIN wine doesn't get Russian registration
Class 46 has learned that the Russian Patent Disputes Chamber recently upheld the decision of Rospatent -- the Russian Patent and Trade Mark Office -- to reject the application of French wine producer Les Grands Chais de France to register the word JELZIN as a trade mark in Russia. According to the Russian authorities, “Jelzin” is used as the German-language transliteration of the former Russian President Boris Yeltsin’s surname. Examples including the German-language version of Wikipedia, the Universal-Lexikon encyclopedia and Der Spiegel magazine. Since the word so closely resembled the late president’s name, it could therefore lead to association with both him and the Russian state and therefore confuse consumers. Boris Yeltsin, incidentally, had not given his consent to the use of his name for wine -- though it appears that he has lent it to a range of vodka products (see illustration).
Les Grands Chais de France claimed that Wikipedia could not be considered an official, trustworthy source of information, stating that the German Brockhaus encyclopedia did not list “Jelzin” as a spelling of the late president’s name.
