VOGUE famous in Serbia, IP Office rules
A recent ruling of the Serbian Intellectual Property Office (Decision Z-2008-753/10, February 22 2011) has held that Condé Nast's VOGUE trade mark is famous in Serbia. On this basis the Office rejected an application by Pentaflon Ltd to register as a trade mark the word VOGUE for watches. This decision, which has not been appealed, is now final.

VOGUE famous in Serbia, IP Office rules
The Office (which carries out ex officio examinations on relative grounds) refused the application on the ground that registration of VOGUE for watches would take unfair advantage of, and would dilute, the reputation of the famous VOGUE mark.
The Office observed that the goods covered by Pentaflon’s mark were related to those covered by Condé Nast’s trade marks for fashion magazines in as much as fashion magazines advertise luxury goods, such as jewellery and watches. On this basis the relevant public often associates these goods with the world of fashion and glamour, for which the famous trade mark VOGUE stands.
