iPOD well-known in Turkey

Last week International Law Office carried a feature by Ugur Aktekin and Hande Hancer (Mehmet Gün & Partners, Istanbul, Turkey), on a recent dispute involving the trade mark IPOD. A local company, Tunc Tekstil, applied to register the iconic word for goods in Classes 25 and 35. The Re-examination and Evaluation Board of the Turkish Patent Institute (TPI) rejected the application, having considered that the well-known status of Apple Inc’s iPOD trade mark warrants grounds for opposition. The authors point our that this decision shows that the TPI was content to accept the evidence filed by Apple to the effect that the mark was well-known, even though Apple’s iPOD trade mark was not recorded as a well-known trade mark in TPI’s official registry.
