New standard format for OHIM opposition decisions
Here’s some promising news from the OHIM website.
OHIM has now introduced a new standard lay out for the reporting of opposition decisions, with the aim to make the reasoning and outcome of the decisions easier to understand.
Decisions from now on will be structured in the following 6 sections:
-
comparison of the g&s;
-
comparison of the signs;
-
dominant and distinctive elements in the signs;
-
distinctiveness per se / enhanced distinctiveness of the earlier sign;
-
the relevant public and the level of attention; and
-
the global assessment.
Besides making the reasoning clearer, the new format should also produce more concise decisions and improve the decision-making process.
More info on the new format will follow in the December's edition of OHIM’s Alicante Newsletter.
