New UK guidance on requests for cross-examination in Registry proceedings
The Intellectual Property Office in the United Kingdom has published TPN 3/2010, a Tribunal Practice Notice setting out guidance on requests for cross-examination of witnesses in the course of Trade Marks Registry proceedings. There is now a presumption in favour of cross-examination -- but the registrar, as part of his case management powers, must weigh up its advantages and disadvantages before allowing it.

The Intellectual Property Office in the United Kingdom has published TPN 3/2010, a Tribunal Practice Notice setting out guidance on requests for cross-examination of witnesses in the course of Trade Marks Registry proceedings. There is now a presumption in favour of cross-examination -- but the registrar, as part of his case management powers, must weigh up its advantages and disadvantages before allowing it.
The Notice also provides a checklist of the information that parties should include in any request for cross-examination.
There is no indication in the Notice as to the date from which it takes effect, so it is unclear whether it applies only to proceedings which have not yet commenced or also to those which are already in progress.
