Oréal v Bellure: strong criticism for the European Court of Justice
Following the ruling of the Court of Justice of the European Union in Case C-487/07, the Court of Appeal for England and Wales -- the referring court -- has given its decision this morning in L'Oréal SA & Others v Bellure NV & Others [2010] EWCA Civ 535.

Oréal v Bellure: strong criticism for the European Court of Justice
Following the ruling of the Court of Justice of the European Union in Case C-487/07, the Court of Appeal for England and Wales -- the referring court -- has given its decision this morning in L'Oréal SA & Others v Bellure NV & Others [2010] EWCA Civ 535.
Today's decision is notable not so much for its result, which was not in doubt once the Court of Justice had given its ruling, but for the highly outspoken manner of the criticism of that ruling by Lord Justice Jacob, with whom the other members of the Court of Appeal concurred.
