PharmaResearch appeal fails
In Case T‑464/07 Korsch AG v OHIM the Court of First Instance of the European Communities dismissed Korsch's appeal against a refusal to grant a Community trade mark for the word PharmaResearch. The application was made for « Appareils et instruments électriques et électroniques pour saisir, gérer, enregistrer, évaluer, surveiller et transmettre des données de produits et de machines et des données externes » in Class 9; the application was refused for lack of distinctive character and for descriptiveness under Articles 7(1)(b) and 7(1)(c) of Regulation 40/94. This judgment is available in French and German only.
