Lindt chocolate bunny shape correctly ruled unregistrable, says court
"The shape of a chocolate rabbit with a red ribbon cannot be registered as a Community trade mark" is the headline of the Curia press release that announces and succinctly summarises the ruling of the Court of Justice of the European Union in Case C-98/11 P
Chocoladefabriken Lindt & Sprüngli AG v OHIM, which you can read in full here. According to the Court, the General Court had not misdirected itself when it found that the Easter bunny shape was devoid of distinctive character.
