In Judgment T-28/10, the GC confirmed that EURO AUTOMATIC PAYMENT is descriptive for goods and services in Classes 9 and 36. For the relevant English-speaking public, it has a direct significant meaning related to telecommunications and the banking and financial sector, such as ‘euro’ for the currency and ‘automat’ being a direct reference to the expression ‘automated teller machine’ – rather known as ATM- to designate bills/notes automatic distributer machines.
