In the T-497/09 judgment, KOMPRESSOR PLUS was held descriptive for the Dutch, English and German-speaking public for Class 7 goods “electric vacuum-cleaners” on the ground that ‘PLUS’ is a simple superlative and the end user as well as professional public, will perceive ‘KOMPRESSOR’ as referring to material associated with vacuum cleaner and air compressor since the latter are used in connection with steam cleaning apparatus. Moreover, as noted by the Board, high pressure blowing and air distribution can be obtained by vacuum cleaner system, by adding a removable air hose at the outing of the suction system; this is a well-known fact as found by OHIM on external websites related to these goods “more than a vacuum cleaner, this is a real little compressor". It was kept on the register for “Electric washing machines; automatic dishwashers for household”.
