Portugal - Sound Mark with electronic audio file: First Electronic Filling
For the first time in Portugal a sound trademark with an integrated electronic audio file was applied for. The electronic audio file, incorporating the melody of the trademark sign, is accessible through INPI's online services, >Direct search by application number, > National Trademark > 480308. The electronic file is also available in the Industrial Property Bulletin, being also accessible in all digital certificates related to this trademark file. INPI belongs to the restrict group of Intellectual Property Offices worldwide that provide multimedia files in sound trademark's application, publication, online data base access and digital certificates." You can hear the applied for sound trade mark in the following LINK. The requested sign has been used by the applicant (Seguro Directo - a Portuguese insurance company) for as long as we can remember, but only now is this company trying to register this particular sound to cover Insurance Services (Class 36 of the International Nice Classification). The trade mark application has been published in the Portuguese Bulletin of Intellectual Property no. 161/2011 (24 August 2011). As a result, the same can yet be opposed - two months deadline ending in 24 October 2011 - by any third party that claims a prior right over such sound.
