Registry or Court - which is better?
My colleague Professor Suthersanen asks: Should all EU states offer invalidation procedures for designs at their national Registries? We have this in the UK and, recently, in Germany as well, of course, as at OHIM but not in all States - WIPO in 2008 noted that Spain, Portugal and the Benelux office do not offer administrative invalidation.
The changes to EU Trade Mark Law require this for trade marks. Should we also do so for designs? What about countries where only a small number of designs are filed - would you get a better result from the Registry or the Court?
