Complex designs and watches: a new article
"Conflicts between complex signs and designs: some observations from the European watch industry's perspective" is the title of a new article by Henning Hartwig which was first published ponline yesterday in the subscription-baed Journal of Intellectual Property Law & Practice (JIPLP). According to the abstract,
Watches are complex product configurations but seldom subject to a conflict between trade mark and design rights.
A recent decision of the Frankfurt Court of Appeal involving both complex signs and designs provides valuable guidance in judging validity and infringement issues under European design and trade mark law.
