Poland: inspiration or plagiarism?

News regarding trade marks is not so popular in Polish mainstream media, but a recent case of Bialystok city's logotype made the headlines and was widely commented upon.

The municipality of Bialystok commissioned Polish company Grupa Eskadra to create a logotype. The company from Kraków also won a tender worth 2,7 million PLN to create a promotional identity campaign for the city of Bialystok. Internauts from Bialystok found that Grupa Eskadra's project was almost identical to The Lesbian, Gay, Bisexual & Transgender Community Center from New York City. The issue of plagiarism had to be resolved by lawyers. Urszula Sienkiewicz, the city's spokeswoman told to the press that Tadeusz Truskolaski (president of Bialystok) sent an official letter to the organization.
- in his letter, which was sent on Friday, the President spoke about the action taken by the city and asked for access to the organization's logo, which is needed for legal expertise. We hope that this problem can be solved by dialogue and understanding.
Grupa Eskadra issued its own statement.
...the similarity of the logo designed for Bialystok city with the logo used in the past by one of New York social organizations is strictly coincidental and unintentional. Graphic motifs present in Bialystok's logotype occur in a variety of logos from different countries, different companies or institutions. The most common is the symbolism associated with the idea of rising sun (...)
This kind of situation associated with the similarity of characters, concepts and themes occurs in the world of graphics design extraordinarily high. There are hundreds of examples where, working independently of each other, designers in different parts of the world come to alike concepts of shape and colour.
Grupa Eskadra has also presented some examples.
