Germany: BGH "AdWord" decision coming soon

Google 'AdWords' have been a hot topic - and a source of legal uncertainty - in Germany for several years, with the Higher Regional Courts deciding differently on the question whether using a competitor's trade mark as an 'AdWord' constituted trade mark infringment. The German Federal Supreme Court (BGH) has now announced (press release No. 10/2009 of 15 January 2009) that its long awaited decisions in three 'AdWord' cases will be published on 22 January 2009. The case references are I ZR 125/07, I ZR 139/07 and I ZR 30/07.
