The new Company Names Tribunal (see earlier posts here and here) has given its first decision, this being in favour of The Coca-Cola Company. The ruling gives Coke Cola Limited until 3 January 2009 to change its name, failing which a new name will be chosen for the company by the adjudicator. The background to this dispute was noted by Class 46 here.

Acting for The Coca-Cola Company in these proceedings was law firm Simmons & Simmons. David Stone (an IP partner in the firm's London office) said:

"Many small businesses think that their UK company name registration gives them rights to use the name - it does not. This new, efficient system helps right these wrongs quickly and efficiently, so consumers are not confused.

"The Tribunal is to be congratulated for its swift and efficient handling of this, the first case to come before it. The matter has been resolved in just over eight weeks, and with a £700 contribution towards Coca-Cola's costs. This is welcome Christmas present for brand owners and for consumers."
