Today in the Court of First Instance
The Court of First Instance of the European Communities processed three Community trade mark appeals today. They are
* Case T‑179/07 Anvil Knitwear v OHIM, Aprile e Aprile srl: application to register the Aprile figurative mark (above) in Classes 18 and 25 (various clothes and accessories); appeal against rejection of opposition based on earlier German word mark ANVIL dismissed.
* Case T-116/06 Oakley Inc v OHIM, Venticinque Ltd: word mark O STORE for retail sales of accessories (Class 35); appeal against declaration of invalidity based on earlier French registration of word mark THE O STORE (Classes 18 and 25) dismissed.
* Case T-248/05 HUP Uslugi Polska sp. z.o.o. v OHIM, Manpower Inc: word mark I.T.@MANPOWER for goods and services in Classes 9, 16, 35, 38, 41 and 42); appeal against refusal of a declaration of invalidity based on absolute grounds of unregistrability dismissed.
