The next MARQUES webinar takes place on 28 February and the topic is: Advertising slogans – highly creative, poorly protectable? Possible solutions.
The webinar will provide an overview of whether slogans are protectable and registrable in Europe and the United States.
Currently slogans are treated in Europe as in most countries around the world from a legal point of view as trade marks. But in the trade/advertising ecosystem (real world), trade marks (brands) and slogans (in general short living catchy taglines used to enhance a brand) are different and have different purposes. This generates an important obstacle for the protection of slogans, since many of these signs do not accomplish the level of distinctiveness required for trade marks or copyrights.
The webinar will be presented by Robert Horowitz of Baker & Hostetler LLP, USA and Juan Carlos Durand Grahammer of Durand Abogados, Peru. Both are members of the MARQUES Famous and Well Known Marks Team.
During the webinar, Robert and Juan Carlos will interview industry representatives about the process of creating slogans from an advertising agency’s perspective; whether legal aspects for them are considered; what difficulties advertising agencies face to obtain the protection of slogans; and whether self-regulation is a way to surpass the difficulties concerning the protection of slogans. The industry panellists are:
