SOFT BLUE appeal fails
The Court of First Instance of the European Communities (CFI) rendered its decision on Wednesday in Case T‑330/06, Novartis AG v OHIM. The decision is available so far only in French and German. In short, Novartis applied to register the words SOFT BLUE as a Community trade mark for contact lenses (Class 9). The examiner considered the mark lacking in distinctive character under Regulation 40/94, Art. 7(1)(b); the Board of Appeal held it both non-distinctive and descriptive. The CFI dismissed the appeal.
