FUENTE ESTRELLA: another CTM appeal goes to Luxembourg
Only last night did we draw attention to a fresh Community trade mark appeal that is heading towards the Court of Justice of the European Union (CJEU) in Luxembourg -- and now here's another one. It's Case C-399/15 P Vichy Catalán v OHIM.
This is an appeal against the ruling of the General Court in Case T-302/15 [so far available in French and Spanish only] on the grounds of force majeure and the incorrect interpretation of the Rules of Procedure. The application itself appears to involve the word mark "fuente estrella" (Google Translate renders these words "Star source" in English).
If you would like to comment on this case and advise the UK government whether it should be taking an interest in it, please email policy@ipo.gov.uk by 23 December 2015.
