Russia fine-tunes "well-known mark" administration rules
Class 46 understands that, with effect from 13 October 2015, new administrative rules on declaring trade marks as being wellknown entered into force in Russia.
The main change concerns the prescribed time limit for Rospatent -- the Russian IP Office -- to determine whether a trade mark is indeed well known. While there used to be no time limit, the new rules establish that this term is to be a maximum 10 months from the date of application for recognition of a well-known mark through administrative proceedings.
(As an aside, while administrative proceedings take time and proper procedures must be respected, it is hard to resist the temptation to suggest that, if it takes more than 10 months to establish that a mark is well-known, maybe it isn't all that well known after all).
