ALPHAREN/ALPHA D3 dispute goes to CJEU
The General Court's decision in Case T-106/12 Cytochroma Development, Inc. v OHIM, Teva Pharmaceutical Industries (ALPHAREN) has now been appealed to the Court of Justice of the European Union as Case C-490/13 P. This case involves an application to register the word mark ALPHAREN as a Community trade mark for pharmaceutical products (‘Pharmaceutical and veterinary preparations containing magnesium iron hydroxy carbonate or hydrotalcite or derivatives of these compounds; pharmaceutical and veterinary preparations for use in renal dialysis and in the treatment of renal diseases and kidney ailments; phosphate binders for use in the treatment of hyperphosphataemia’) in Class 5, which was opposed -- eventually successfully -- by Teva as owner of ALPHA D3 word marks for Class 5 products (calcium regulators) in Hungary, Latvia and Lithuania.
