Slovakia proposes charitable donation of safe fakes
The Slovak Spectator has recently reported that the Slovak Republic's Finance Ministry has proposed a radical customs legislation amendment that would allow the donation of seized counterfeit goods without the trade mark owner’s consent. Normally, fakes seized by customs officials are destroyed at the rights owners’ request and expense. However, it sometimes happens that the customs authorities give the goods away for humanitarian purposes -- provided the trade mark owner gives his consent. 

Under the draft amendment, the Administration of State Material Reserves will be also entitled to offer the goods to facilities caring for orphaned children, in addition to victims of natural disasters or similar emergency situations, healthcare networks, social care organizations and NGOs, as the current law prescribes. The donated products will still have to pass product safety checks and the recipients will have to pay for the removal of the trade mark from the goods. 

If Slovakia's parliament approves the amendment, the right owner’s consent will no longer be required as of 1 January 2014.
