Medinet seniority ruling heads for CJEU

Case T-378/11 Franz Wilhelm Langguth Erben GmbH & Co. KG v OHIM, a General Court noted here on Class 46 by Laetitia, is currently awaiting an appeal to the Court of Justice of the European Union. It has now been renumbered Case C-412/13 P. The subject of the appeal relates to the appellant's seniority claim for a figurative mark -- a subject that, to this blogger's recollection, has not previously been contemplated by Europe's senior appeal court.
