Trade marks in the journals: some recent articles
The October issue of the European Intellectual Property Review (EIPR), published monthly by Sweet & Maxwell, leads with a piece by Désirée Fields and Hiroshi Sheraton (both from the London office of McDermott Will & Emery LLP) on the European Commission's proposals for Europe's trade mark system, as well as a discussion by veteran South African IP practitioner Owen Dean of whether his country's constitution protects tobacco products against the sort of 'plain packaging' legislation that has been held constitutionally sound in Australia. Just out today, the November issue of the EIPR carries a case note by James Agnew (Simmons & Simmons LLP) on the battle for use of the term 'Greek Yoghurt' in the United Kingdom.

The most recent issue of The Trademark Lawyer, published bimonthly by CTC Legal Media, features a country focus on trade marks in Russia by Vladimir Biriulin and Alexander Nesterov (Gorodissky & Partners), a review of Polish and OHIM practice concerning the concept of non-distinctiveness by Izabella Dudek-Urbanowicz (Patpol) and some comments on the impact on SMEs of the European Commission's proposals for Europe's trade mark system, by academics Max Oker-Blom and Ewa Grabiak (for ECTA).

The November issue of the Journal of Intellectual Property Law & Practice (JIPLP), published monthly by Oxford University Press, features current intelligence case notes on recent trade mark cases by Birgit Clark (Baker & McKenzie LLP), Adrian Smith and Alexander Bienert (Simmons & Simmons LLP) as well as an article by Andrew Bailey (Macfarlanes LLP) on trade mark functions and protection for marks with a reputation.
