UKIPO: Revised TM33(P) form
The UKIPO has introduced a new form TM33(P) for use in all legal proceedings before the Trade Marks Tribunal. The new form is available on the UKIPO's website from today, Monday 21 April 2008. In advance e-mail which was sent to subscribers on Friday the UKIPO explains reasoning behind the new form as set out below:
"The current Form TM33 is not designed to accommodate changes to agent or contact details when the request is in respect of a case involved in inter partes proceedings before the Trade Marks Tribunal. Errors have occurred when a TM33 is used to record changes which are not global in nature.
To avoid any further mistakes and inconvenience being caused to our customers, the Trade Marks Registry has introduced an additional Form TM33 which parties to proceedings are requested to use with immediate effect.
In addition to asking for details of the new agent and/or contact address, the new form also requires the applicant to identify the UK-IPO reference for the relevant proceedings (opposition number, revocation number, invalidation number or rectification number), and the signatory will have to confirm its own role in the proceedings.
Changes to the proprietor details, for those cases not involved in legal proceedings, can be made on the revised TM33."
