Red Bull fights
On 29 October 2009, the Polish Patent Office registered the word-figurative trade mark RED PUMA ENERGY DRINK R-221326 for goods in Class 32 such as energy drinks. Red Bull GmbH filed a notice of opposition against the decision of the PPO. Red Bull claimed that RED PUMA ENERGY DRINK is similar to series of its trade marks and infringes on the Red Bull’s reputation.
On 8 September 2009, the Polish Patent Office granted the right of protection for the word-figurative trade mark ICE COOL ENERGY DRINK R-221430for goods in Class 32 such as non-alcoholic beverages and energy drinks. Once again Red Bull opposed.
The Adjudicative Board of the PPO in its decision of 11 July 2012 case no. Sp. 476/11 dismissed the opposition against RED PUMA ENERGY DRINK, and in its decision of 13 July 2012 case no. Sp. 479/11, the PPO dismissed the opposition against the trade mark ICE COOL ENERGY DRINK. Both decisions are not final yet.
