Commodore trade mark: quo vadis?

On April 15, 2008 the District Court 's-Hertogenbosch declared Commodore International B.V. bankrupt upon request of certain creditors (apparently the petitions are trade partners of Commodore International). Commodore International B.V., subsidiary of Commodore International Corporation (CIC), was owned by Tulip Computers N.V., before it was sold to CIC in 2004. A press release on CIC's website reads that in the meantime it has been established by CIC and the petitioner(s) that procedural mistakes resulting in this judicial declaration were made erroneously beyond CIC's control. According to the press release the parties concerned have signed an agreement to get the bankruptcy decision invalidated. Commodore International is recorded as owner of the figurative Commodore trade mark. The Benelux registry shows that the Benelux trade mark has been pledged to amongst others Tulip Computers N.V., probably to secure payment of loans. Bert van Wijhe - Commodore International's CEO informed Dutch press office ANP these days that Commodore International needs fresh money to get out of trouble. The (rights to the) legendary trade mark are presented as a bait to attract investors.
