Russian anti-monopoly authority rules trade mark assignment unfair
"Natur Product International Fined for Illegal Acquisition and Use of the Word Trademark AntiGrippin" is the stern title of a brief item in the current issue of the ARUC newsletter. ARUC is the Association for Resistance to Unfair Competition, the Ukrainian branch of the Swiss-based LIDC (International League of Competition Law).
According to this item:
On March 6, 2012 the Federal Antimonopoly Service (FAS of Russia) imposed on Natur Product International CJSC an administrative fine in amount of 300 thousand roubles for unfair competition. Earlier, the Commission of FAS of Russia decided to declare actions of Natur Product International CJSC regarding acquisition and use of exclusive rights to the word trade mark Anti-Grippin with certificate No. 406816 and combined trade marks with certificates No. 375093 and No. 375094 as unfair competition pursuant to part 2 article 14 of the Federal law “On Competition Protection”. Sign AntiGrippin was previously used by other economic entities. Natur Product International CJSC registered this previously used sign in the Rospatent and then accused economic entities that previously used this sign of violation of exclusive rights.
