Poland: food labelling
The Polish Trade Inspection fined the Centuria company that operates Intermarche stores in Szczecin, for selling butter products in the packaging that included the label "extra butter 82%". However, this product included only 62 percent of milkfat, and the Council Regulation (EC) no 1234/2007 provides that a product called butter must contain between 80-90% fat. According to the provisions of the Polish Act of December 21, 2000 on Commercial Quality of Agricultural and Food Products, whoever is marketing adulterated food and agricultural products, should be fined in an amount not greater than 10% of the revenue earned in fiscal year preceding the year of imposition of penalty, but not less than 1000 PLN. Centuria filed a complaint against this decision but it was dismissed by the Voivodeship Administrative Court in Warsaw in its judgment of 17 October 2011 case file VI SA/Wa 1371/11.
