Ara v OHMI - Allrounder
In Judgment T-174/10, the General Court rejected the action brought against the decision of the BoA which held there is no likelihood of confusion between earlier German word mark A and the figurative CTM of a representation of the letter ‘A’ with two horns for in part identical and in part similar goods in Classes 18 and 25.
The signs have a slight degree of similarity visually and conceptually and cannot be compared aurally because the figurative elements neutralize the effect of identifying the CTM with the letter ‘A’; the earlier mark, being a single letter, has a low distinctive character.
