New Ukraine trade mark fees in the offing
New official IP fees will be introduced in Ukraine on the day when country becomes a member of the World Trade Organization (WTO). The new official fees were approved by the government in Resolution 1148/2007 and have also received the approbation of the World Trade Organization's General Council. Ukraine must ratify the new arrangement by 4 July 2008, becoming a WTO member 30 days after the ratification.
Right now, Ukraine's official fees depend on the annual gross domestic product (GDP) per capita in the applicant or IP owner's country of residence. The countries are divided into two groups, based on World Bank statistics,with businesses and individuals countries with an annual per capita GDP of less than $3,000 paying lower fees than those from countries with a higher figure. After the changes, the official fee for filing trade marks in black and white is €135 per international class (there's an additional €68 for colour). The official publication fee per class for black and white marks is €20 (with an extra €13 for colour).
Although the new official fees are set in the Ukrainian currency, residents of foreign countries will be able to pay in US dollars or in euros based on the official exchange rate of the National Bank of Ukraine as of the date of payment (source: an International Law Office article by Galina Mykolenko, Konnov & Sozanovsky, Kiev.
