Boomerang look-alike figurative trademark not distinctive
In Judgment T-202/09, the CTM figurative trademark ‘Representation of a curved band with dotted lines’ has been found to be non-distinctive by the General Court for Class 10 ‘Orthopedic shoes’ and Class 25 ‘shoes’. The shape and characteristics (dotted lines similar to sewing lines) of the trademark are banal and will be perceived by the average consumer as an adornment or some material destined to the reinforcement of shoes, which is common place in the footwear industry.
