Greece - Comparative advertsing ignites passion in mobile telpehony

It seems that the land of Greek comparative advertising is inhabited by mobile telephony providers (readers of this blog may recall and earlier Greek mobile telephony – comparative advertising brawl). This time, the advertising battle has broken out between Vodafone and WIND. Vodafone aired a tv spot, in which certain mobile telephony products of the three Greek providers (Vodafone, COSMOTE and WIND) were compared. The winner was of course Vodafone. WIND were not very pleased and within a matter of days aired a tv spot in reply. The tv spot is not an advertisement – it is a reply to Vodafone’s ad claiming that Vodafone purposely excluded from its comparative exercise one of WIND’ products, which, according to WIND, offers more to consumers. Additionally, both WIND and COSMOTE appealed to the Communication Review Board claiming that Vodafone's ad is inaccurate and does not include all of their products, and seeking that Vodafone be asked to cease the said ad. The Board, which convened on an urgent basis last Friday, ruled that, in principle, the entity being advertised (Vodafone) should be free to choose who to compare itself with, provided that such comparison would not exclude the main players of the relevant market (the mobile telephony market in Greece actually comprises of these three entities). However, the Board held that the manner in which the comparison took place could mislead consumers as to the characteristics of the products involved and has asked Vodafone to amend the advertisement and submit it to it for review before airing it.
