The Malta Independent Online reports today that Green.MT Ltd., a Maltese waste management organization, set up by the Malta Chamber of Small and Medium Enterprises (Malta’s national organisation of private businesses) is facing trade mark infringement actions from Der Grüne Punkt Duales System Deutschland GmbH and GreenPak Ltd., for using a confusingly similar green dot trade mark (original on the left side). The Green Dot trade mark (registered for example as a CTM 000298273) notifies consumers, retailers and authorities that a contribution has been paid to the Green Dot organization (set up to achieve the recovery and recycling targets set forth in EU Packaging Directives). The writ has been filed in the First Hall of the competent Maltese Civil Court.
