New Decision on Asset Recovery
The Official Journal of the European Union has now published Council Decision 2007/845/JHA of 6 December 2007 concerning cooperation between Asset Recovery Offices of the Member States in the field of tracing and identification of proceeds from, or other property related to, crime. This Decision, which took effect immediately upon its publication, requires EU Member States to set up Asset Recovery Offices that are mandated to cooperate with one another in tracing laundered money and the proceeds of crime and in exchanging information with one another -- subject only to the EU rules on data protection.
The Decision, which is an important piece of the Commission's fight against organised intellectual property crime -- does not confer any rights on individuals but merely places a duty on governments to establish a workable asset recovery system.
