German Federal Patent Court: opposition based on a converted Community trade mark application
In an advance publication the German Federal Patent Court (Bundespatentgericht) today published the following brief guidelines (Case ref: 32 W (pat) 272/03 of 8 August 2007 ;"WEB VIP/VIP"):
An opposition which was based on a Community trade mark application remains admissible, even if the Community trade mark application is refused and then subsequently converted into a legally effective German national application. [This is a change to BPatG Mitt. 2005, 277 - TAXI MOTO].
