Charcuterie marks not similar, rules CFI
In Spanish and French only the Court of First Instance of the European Communities has published its decision in Case T-242/06 Miguel Cabrera Sánchez v OHIM, Industrias Cárnicas Valle, SA. It's a likelihood of confusion" case under Article 8(1)b) of the Community Trade Mark Regulation.
Industrias Cárnicas Valle applied to register the figurative mark on the right; Sánchez opposed, citing the earlier Spanish mark on the left. The CFI has agreed that they are not likely to cause confusion, despite being used for similar goods. Essentially, before they can be confusingly similar, they have to similar -- which they weren't.
