Gateway appeal turned down
The Court of First Instance posted its decision in Case T‑434/05 Gateway, Inc. v Office for Harmonisation in the Internal Market (Trade Marks and Designs) (OHIM), Fujitsu Siemens Computers GmbH today. It dismissed Gateway's application to annul the Board of Appeal's decision not to allow its opposition to an application by Fujitsu Siemens to register the word mark ACTIVY Media Gateway in Classes 9, 35, 38 and 42. The grounds of opposition were an alleged likelihood of confusion with its earlier registered word and device marks containing the word GATEWAY and dilution, as well as prior unregistered rights.
