Honest use of Lego name permitted
The World Trademark Report last week carried a note on a ruling from the Danish Supreme Court (Case 117/2006, 6 November 2007) that an artist, born Louise Lego Andersen but subsequently known as Louise Lego, was held entitled to use the name Lego for her art gallery (Galleri Lego) and in her domain names, despite the risk that it would be instantly associated with the well-known mark LEGO for toys. Under the Danish law on names, Andersen was entitled to change her name -- and her use was regarded as an honest commercial practice.
